WARNING: The activities provided by Gold Coast Wake Boat Hire Wake Pty Ltd (referred to as the "Organiser" herein) may be dangerous. By signing this document, you acknowledge and understand that you are voluntarily participating in these activities at your own risk.

This document is a legal contract that limits the Organiser's liability for injury resulting from participation in these activities. This must be completed and returned by all patrons prior upon booking confirmation prior to the day of hire. Anyone who will be on the boat must complete the below.

LIFE JACKET SIZING

Safety is our priority. Ensuring our passengers have a snug fitting life jacket is an important part our safety procedures.

SHOE SIZING (FOR WAKEBOARDING)

When wakeboarding, the right size boot provides a secure fit, allowing you to transfer energy efficiently from your feet to the board. Please type your shoe size in the following way eg. "WOMEN SIZE 9" OR "MENS SIZE 10"

WHAT IS YOUR SHOE SIZE?

Health Information:

- I affirm that I am medically (including physically and mentally) able to participate in the activities.
- I do not have a history of neck, back, knee, or joint problems.
- I do not have a history of hypertension or heart problems.
- I have not experienced respiratory symptoms, fevers, coughs, shortness of breath, or breathing difficulties in the last 14 days.
- I have not been in close contact with anyone who was a confirmed case of Covid-19, nor have I been in close contact with someone who is currently being tested for Covid-19.
- I have not returned from overseas in the last 14 days.

Assumption of Risk:

By participating in the activities offered by the Organiser, you acknowledge and agree to the following:

1. You understand that the activities involve inherent dangers and risks, including the real risk of injury or death.
2. You participate in these activities voluntarily and at your own risk, with full awareness of the nature and extent of the risks.
3. You will not attempt any reckless or dangerous manoeuvres.
4. You will follow the directions of the Organiser and its employees and agents.
5. You have the right to stop at any time for any reason and inform the Skipper if you feel unsafe or lack confidence.

Release and Waiver:

1. In consideration of being allowed to participate in the activities, you agree to waive any and all claims that you may have now or in the future against the Organiser. You release the Organiser from any and all liability for any loss, damage, or expense associated with injuries or harm you may suffer as a result of your participation in the activities. This release includes, but is not limited to, contusions, abrasions, strains, sprains, low back pain, rib fractures, ankle and hamstring sprains or strains, ACL tears, concussions, fractures of the spine, and death.
2. This document does not prevent the Organiser from relying on any laws (including statutes and common law) that limit or preclude their liability.
3. Nothing in this document excludes any term or guarantee which, under statute, cannot be excluded; however, the liability of the Organiser is limited to the minimum liability allowable by law.
4. This Release and Waiver is governed by and interpreted solely in accordance with the laws of Queensland, Australia.
5. The Organiser has the right to terminate the event if there is a continued breach of these terms that may cause a safety risk or if instructions are not followed by the participants.
6. A participant's activity can be terminated if the Organiser determines there is a safety issue. One warning will be issued unless it is a serious violation, in which case the participant will be stopped immediately.

- I am aware of the risks associated with the activities and understand that I am responsible for my safety.

Required Medical Treatment:

- I consent to any medical treatment deemed necessary by the Organiser in the event of injury or illness during the activities. I agree to indemnify the Organiser for the cost of such treatment.

I confirm that the information provided above is true and correct. I understand all risks associated with the activities and agree that in the event of a serious breach, there will be no refund.

Media Release

By signing this waiver, I, the undersigned participant, hereby grant the Organiser the right and permission to use any photographs, video recordings, or other media taken during my participation in the wake boat activities for promotional, advertising, and marketing purposes. This includes, but is not limited to, social media posts, website content, brochures, and other promotional materials. I understand and agree that:

- I will not receive any compensation for the use of such media.
- I waive any right to inspect or approve the finished product, including written copy, that may be created in connection with these images or video.
- All media will be the property of the Organiser, and I release the Organiser from any liability related to the use of these images or video.
